Terms of service

1. Acceptance of Terms

By downloading, installing, or using the ContractorsHub application or website (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. We reserve the right to update these Terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

ContractorsHub is a marketplace platform that connects contractors (businesses that post jobs) with technicians (trade professionals who perform the work). We provide tools for job management, communication, payments, and reviews. ContractorsHub is not a party to any agreement between contractors and technicians and does not employ technicians or guarantee the quality of any work performed.

3. Eligibility

• You must be at least 18 years of age to use the Platform.
• You must be a legal resident of the United States.
• Technicians must complete identity verification through Stripe Connect before accepting payments.
• You represent that all information you provide is accurate and current.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information.
• Notify us immediately of any unauthorized use of your account.
• Not share your account with any third party.
• Not create multiple accounts to circumvent Platform rules or restrictions.

5. Contractor Responsibilities

• Post accurate job descriptions, budgets, and requirements.
• Communicate respectfully with technicians.
• Pay agreed amounts promptly upon satisfactory completion of work.
• Not solicit technicians to work outside the Platform to avoid fees.

6. Technician Responsibilities

• Hold all required licenses and certifications for your trade.
• Complete work as agreed and to a professional standard.
• Carry adequate insurance for your work.
• Complete Stripe KYC verification before accepting payments through the Platform.
• Not misrepresent your qualifications or experience.

7. Payments and Fees

All payments on the Platform are processed by Stripe, Inc. By using our payment features, you agree to Stripe's Terms of Service and Stripe Connect Agreement.

• ContractorsHub charges a platform fee on each transaction. The current fee is disclosed at the time of payment.
• Payouts to technicians are subject to Stripe's standard payout schedule.
• Disputed transactions are handled through our dispute resolution process (see Section 8).
• We reserve the right to adjust fees with reasonable notice.

8. Dispute Resolution

If a dispute arises between a contractor and technician, the parties should first attempt to resolve it directly through the Platform's messaging system. If unresolved:

• Either party may escalate the dispute through the Platform's dispute portal.
• ContractorsHub will review submitted evidence and make a good-faith determination.
• Our determination is final for purposes of fund release, but does not prevent either party from pursuing legal remedies.

9. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Post false, misleading, or defamatory content.
• Harass, threaten, or abuse other users.
• Attempt to circumvent Platform fees by transacting off-Platform.
• Reverse engineer, scrape, or otherwise misuse the Platform's systems.
• Upload malicious code or interfere with Platform operations.

10. Intellectual Property

All content, trademarks, and software on the Platform are owned by ContractorsHub or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose. You retain ownership of content you submit (job descriptions, photos, messages) but grant us a license to use it to operate the Platform.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. CONTRACTORSHUB DOES NOT:

• Guarantee the quality, safety, or legality of any work performed by technicians.
• Verify that technicians hold all required licenses (though we encourage users to confirm this).
• Guarantee uninterrupted or error-free service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTRACTORSHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU TO CONTRACTORSHUB IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any conduct we determine to be harmful to the Platform or its users. You may delete your account at any time by contacting us. Termination does not relieve you of obligations for completed transactions.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which ContractorsHub is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
